1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed by consumers and entrepreneurs through the NapDreem online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.

By clicking the "Buy Now", "Order with obligation to pay" button, or a similar order button, you submit a binding offer to purchase the goods contained in your shopping cart.

After receiving your order, you will receive an automatic order confirmation by email. This confirmation does not yet constitute acceptance of the contract offer.

The purchase contract is only concluded with the shipping confirmation or delivery of the goods.

4. Prices and Payment Terms

All stated prices include the statutory value-added tax, if applicable.

Any additional shipping costs will be shown separately during the ordering process.

5. Delivery and Shipping

Delivery times are indicated on the respective product pages.

Should a product not be available, we will inform the customer immediately.

Partial deliveries are permissible, provided they are reasonable for the customer.

6. Retention of Title

The goods remain the property of NapDreem until full payment has been received.

7. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal.

8. Warranty

The statutory warranty rights apply.

In the event of defects in the delivered goods, customers are entitled to the statutory rights to supplementary performance, reduction, withdrawal, or compensation in accordance with the statutory provisions.

9. Liability

We are fully liable for intent and gross negligence.

In cases of simple negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable, typical damage.

The limitations of liability do not apply to damages resulting from injury to life, limb, or health, or to claims under the Product Liability Act.

10. Vouchers and Discount Promotions

Promotional vouchers can only be redeemed within the specified period.

Cash payment of vouchers is excluded.

Vouchers are non-transferable unless expressly stated otherwise.

12. Dispute Resolution

We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
